Your personal data controller is Proitas, UAB (hereinafter – Proitas), its branches and representative offices, as well as other legal persons used by Proitas for the provision of services which are authorized to act on behalf of Proitas. 2. Personal data collected by Proitas is processed in accordance with the Law on Legal Protection of Personal Data of the Republic of Lithuania, the General Data Protection Regulation, the Law on Electronic Communications of the Republic of Lithuania and other legal acts. All Proitas employees, representatives and the employees of representatives who learn the secret of personal data are obliged to protect it even after the termination of their employment of contractual relationship.

3. For the processing of personal data, Proitas may use data processors and/or hire other persons to perform certain functions on behalf of Proitas at its own discretion. In such cases, Proitas shall take steps to ensure that such data processors process personal data in accordance with Proitas instructions and applicable legal acts and shall require to implement certain personal data protection measures. In addition, Proitas shall ensure that the aforementioned persons are bound by confidentiality obligations and are not able to use such information for any other purposes except to the extent necessary for the performance of the assigned functions.

Data Processing Purposes

 

8. Proitas collects and processes your personal data for the following purposes:

8.1. Provision of electronic services, conclusion and performance of contracts, accounting of clients and settlements;

8.2. Management and recovery of debts;

8.3. Maintaining and administration of relationship with clients, prevention of disputes and collection of evidence (phone conversation recording), business correspondence with the client;

8.4. Protection and defense of Proitas and client’s interests and property (video surveillance at the premises of Proitas). Before entering the premises of Proitas in which video surveillance is carried out, special signs inform you of video surveillance;

8.5. Informing the client of the services. For this purpose, personal data are processed in order to inform their client of the services provided by Proitas, their prices and specifics, amendments to the contracts concluded with the client, for sending Proitas system messages and other messages related to the services being provided. The subject of the personal data confirms that he/she understands that such information messages are necessary for the provision of services, and they are not considered to be the direct marketing messages;

8.6. Direct marketing, in order to present proposals of the services provided by Proitas to the client;

8.7. Other purposes for which Proitas has the right to process your personal data when you express your consent, where Proitas needs to process data for its legitimate interest, or where Proitas is obliged to process the data by the legal acts.

9. Your personal data collected for all specified purposes, other than the name, surname, personal identification number, date of birth and the precise address of the place of residence can be processed for the purposes of statistical analysis. To this end, personal data are processed in such a way that the specific identity of the data subjects would be unidentifiable upon their inclusion in the scope of the statistical analysis. The collection of your personal data for the purposes of statistical analysis is based on the legitimate interests to analyze, to improve and develop the undertaken activities. In all cases mentioned above Proitas processes personal and/or traffic data only to the extent necessary for the clearly defined and legitimate objectives, taking account of the protection of the data subject’s privacy. Proitas shall ensure that personal data are processed accurately, fairly and lawfully, in strict compliance with the clear and transparent statutory personal data management requirements.

11.1 Name, surname, personal identification, date of birth, address, e-mail address, telephone number, payment account number, gender, job position;

11.2. Data related to the supply of equipment and/or services, for example, the service and its ordering details, billing, payment details, information about the consent and disagreement concerning the processing of personal data for the purposes of direct marketing and their provision to third parties, contact details and related entries;

11.3. Data generated while using our services, such as traffic data – connection start date, time, duration, the caller’s subscription number, the number of the subscriber who receives the call, IP number of the Internet user used during the connection, etc.; In addition, voice mail and other call records may be collected; however, such data may be collected only in the case where you have ordered additional recording services;

11.4. Data collected using cookies and similar technologies related to browsing on this website, etc.;

11.5. Telephone call records when you to call to Proitas or answer Proitas employee calls;

11.6. Data of video records in the premises controlled by Proitas.

10. Data providers are the following:

10.1. Directly the very data subject;

10.2. Other sources: other data providers, publicly available registers, enterprises which process joint data files of debtors (for example, Creditinfo Lietuva, UAB);

10.3. The data are generating when you are using the services of Proitas, approach Proitas in writing, by phone, e-mail, visit this website, to the extent provided for by the applicable legal acts.

 

Data Recipients

 

11. Data recipients are the following:

11.1. Proitas service intermediaries (if the services are provided using their services), to the extent required for the provision of the service only;

11.2. Debt management and recovery enterprises, attorneys-at-law, enterprises processing joint data files of debtors. Only the data of data subjects who have failed to discharge their obligations in a due and timely manner (debtors) shall be provided, after giving the data subject a written reminder of the failure to fulfill their obligations and after having implemented the statutory data protection requirements;

11.3. Courts or public authorities under their requests, only to the extent this is necessary for the due implementation of the applicable legislation or a court decision;

11.4. Other entities under a contract with Proitas, only where you gave a separate consent to this end.

12. Data may be provided to third countries in the case where the provision of your electronic communications service is related to the services being rendered in third countries, or a third country partner (correspondent) is used for the provision of the service.

13. Please note that if you delay the discharge of your obligations for a period exceeding 30 days, Proitas shall provide information about your identity, contact details and credit history, i.e. financial and property liabilities and their execution, debts and its payment to the credit bureau Creditinfo Lietuva, UAB (company code: 111689163, address: A. Goštauto g. 40A, LT 01112 Vilnius, Lithuania, www.manocreditinfo.lt, tel.: +370 5 2394131). The credit bureau processes your information and provides it to third persons (financial institutions, telecommunications companies, insurance, power and utility service suppliers, commercial companies, etc.) for legitimate interests and purposes – to assess your creditworthiness and to administer the debt. The credit history data are processed for 10 years after the performance of obligations. You may review your credit history by approaching the credit bureau or using the mobile app Finpass. In addition, you have the right to ask to correct or delete your personal data, or to restrict data processing and the right to object against processing of your data, as well as the right to data portability. More information on the exercise and restrictions of these rights is available on the website www.manocreditinfo.lt. If your rights are violated and you may contact the Data Protection Officer by e-mail duomenu.apsauga@creditinfo.lt or by the above telephone number, or to lodge a complaint with the State Data Protection Inspectorate or to the court.

14. You hereby acknowledge the fact of being informed that your data (e-mail address and/or telephone number) can be processed for the purposes of direct marketing and the fact that you have the right to object and oppose against the use of personal data for this purpose at any time, by giving written notice of your of the objection or opposition to Proitas by e-mail pagalba@Proitas.lt.

15. For the direct marketing purposes, data can be transferred to search engine or social network systems (the opportunity to oppose the processing of such data is ensured on the websites of such systems). No data shall be provided to other persons.

The right to access the data: to receive information of the fact whether Proitas processes your personal data, and if so, to review your personal data processed by Proitas and to receive information of the sources from which your personal data were collected and the types of such data, for which purpose they are collected and to whom they are transmitted or can be transmitted; to receive a copy of one’s personal data processed from Proitas in accordance with the procedure laid down by the legal acts. After the receipt of your written request, Proitas, within the time limit set by the legal acts, shall present the requested data in writing or shall specify the reasons for rejecting the request. Data may be supplied free of charge once in a calendar year; however, in other cases a fee not exceeding data provision costs may be charged.

24.3. The right to request to correct the data: if your personal data processed by Proitas are incorrect, incomplete or inaccurate, to approach Proitas in writing and to request to correct incorrect, incomplete or inaccurate data or to supplement incomplete data by submitting the respective application.

24.4. The right to request to destroy unlawfully, unfairly collected personal data or to stop any further processing of personal data except their storage. Proitas must check the lawfulness of personal data processing free of charge without delay and, if necessary, destroy the data. At the request of the data subject, after stopping the actions of personal data processing, the personal data must be kept until they are corrected or destroyed.

24.5. The right to be forgotten: to request to terminate the processing of data (to delete the data), in the case where the personal data are processed with the consent of the person and the person withdraws the consent, or, where the personal data are no longer needed for the purpose for which they were obtained, or where the personal data have been processed unlawfully, or the personal data must be deleted pursuant to a legal obligation. You should submit written notice of disagreement as regards the processing of personal data to Proitas personally, by post or electronic means of communication. If your disagreement is legally justified, after examining the application, the Proitas will terminate personal data processing actions, with the exception of cases provided for in the law.

24.6. The right to restrict the processing of data: to require to restrict the processing of data where the data subject denies the accuracy of data for the period during which the controller can verify the accuracy of such personal data; where personal data processing is unlawful and the data subject objects against deletion of data and asks to restrict their use instead; the data controller no longer needs the personal data for their processing purposes, but they are needed by the data subject for the establishment, exercise or defence of legal claims. Before applying the data processing restriction, the data controller shall inform the data subject whose data are subject to the processing restriction.

24.7. Data Transferability Right.

24.8. The right to object against processing of your personal data for the purposes of direct marketing, as well as to withdraw the respective consent at any time without stating the grounds of the opposition.

27. The client using the services of Proitas for meeting business and professional interests, agrees that its name and/or logo may be used by Proitas for direct marketing purposes (for example, for Proitas to indicate that the client uses the services of Proitas).

 

Ensuring Information Security

 

28. The goal of Proitas is to ensure the maximum security of all information obtained from the Client and from public data files. Proitas uses the appropriate legal, organizational, technical and physical security measures to protect this information against unauthorized access, use, copying, accidental or unlawful destruction, alteration or disclosure, as well as against any other illegal processing.

 

Final Provisions

 

29. The provisions of this Privacy Policy shall be governed by the law of the Republic of Lithuania. All disputes arising in relation to this Privacy Policy, shall be resolved by negotiations, failing which they shall be resolved before the courts of the Republic of Lithuania.
